Initiative Measure 434
A vote “FOR” will amend the Nebraska Constitution to provide that, except when a woman seeks an abortion necessitated by a medical emergency or when the pregnancy results from sexual assault or incest, unborn children shall be protected from abortion in the second and third trimesters.

A vote “AGAINST” will not amend the Nebraska Constitution in such manner.

Shall the Nebraska Constitution be amended to include a new section which provides: “Except when a woman seeks an abortion necessitated by a medical emergency or when the pregnancy results from sexual assault or incest, unborn children shall be protected from abortion in the second and third trimesters.

Our Explanation

A vote FOR means --

• Nebraska’s current law allowing abortion until 12 weeks would remain in effect. 

• Nebraska could add more restrictions or regulations on abortion in the future. 

• Nebraska may not create laws allowing abortion in the second or third trimesters. 

• Carveouts for abortion in the second and third trimesters in the case of rape, incest, or medical emergency will be confirmed in the Nebraska Constitution. 

 A vote AGAINST means— 

• Nothing will change immediately in Nebraska’s current law, which allows abortion until 12 weeks except in cases of rape, incest, or medical emergency. 

• In the future, Nebraska will be permitted to pass laws that either limit or expand abortion access. 

NOTE:  #434 (Protect Women and Children) is in opposition to #439 (Protect Right to Abortion).  If both initiatives pass, the one with the most YES votes will amend the Constitution.  If neither measure passes, no change would be made in the Constitution.
